CONTRACTUAL RELATIONSHIP AND CONTRACT CONCLUSION

Contractual Relationship

• MyLuxuryChauffeur.com does not provide transportation services directly or through agents. The company only facilitates the user’s right to transportation from an independent TSP.
• To this end, MyLuxuryChauffeur.com enters into agreements with the TSP on behalf of the user, establishing a contract for the user to directly request services from the TSP.
• The arrangement between MyLuxuryChauffeur.com and the user is limited to facilitating the booking, and does not involve the provision of the actual transportation service. The fees charged by MyLuxuryChauffeur.com cover both its arrangement services and the payment to the TSP for the transportation.

Conclusion of Contract

• When the user submits a booking form through MyLuxuryChauffeur.com or makes a booking by phone, they are making an offer to enter into a contract for transportation services (“ride request”).
• MyLuxuryChauffeur.com will send an initial email confirming receipt of the request. However, the contract is only formed when MyLuxuryChauffeur.com sends a separate booking confirmation via email. At this point, the user can directly request services from the TSP.

USER REGISTRATION REQUIREMENTS

The user must provide accurate and complete information when registering or making a booking. Automated registrations are not allowed.

SPECIFIC TERMS OF THE TRANSPORTATION CONTRACT

The user can only request the services outlined in their ride request once agreed upon with MyLuxuryChauffeur.com. The following conditions apply to the transportation services arranged by MyLuxuryChauffeur.com and provided by the TSP:

Ride Types and Service Changes

• Users can select from various ride types, including transfer rides, long-distance rides (200 Miles or more), on-demand services, and hourly bookings, subject to local availability.
• If the user’s requests during the ride differ from the original booking, the TSP may accommodate them, resulting in additional charges. Changes to the booking may also lead to price adjustments as outlined in Section 5.

Transfer and Long-Distance Rides: The price is calculated based on the starting and destination addresses. Additional charges may apply for extra stops as per the price schedule.

Hourly Bookings: Hourly bookings begin at the scheduled pickup time and end within the city of pickup. If the ride extends beyond the city or exceeds the agreed duration or distance, additional fees will be charged.

Pickup Time: The agreed pickup time is specified in the booking confirmation. For airport or train station pickups, the pickup time may be adjusted based on actual flight or train arrival times, provided the user supplies the correct travel information.

Vehicle Class and Upgrades: Users can choose from available vehicle classes, such as “Business Class” or “First Class”. The vehicles displayed on the platform are for illustration only, and the exact model is not guaranteed. MyLuxuryChauffeur.com may upgrade the user to a higher vehicle class at no additional cost, subject to availability.

Safety, Luggage, and Animal Transport: The user must indicate any special requirements for luggage, animals, or child seats at the time of booking. The TSP reserves the right to refuse transport for unapproved luggage or animals. Any additional services may incur extra fees as outlined in Section 5.

Delays and Cancellations: In cases of force majeure, such as weather disruptions or strikes, MyLuxuryChauffeur.com cannot guarantee compensation for delays. Users are responsible for adhering to the cancellation policy, which includes potential charges for late cancellations or no-shows as outlined in Section 4.6.

FEES AND PAYMENT

General Terms: The price stated in the booking confirmation includes both MyLuxuryChauffeur.com service fee and the fee for the TSP’s transportation services. Special requests may incur additional charges.

Changes to the Ride: If the user modifies the ride request after booking, additional charges may apply based on the updated services or distance traveled.

Additional Charges: Waiting times, extra kilometers for hourly bookings, and additional services requested during the ride may incur extra fees.

Payment: Users can pay via credit card or bank transfer. Any credit card fees will be covered by MyLuxuryChauffeur.com, while users are responsible for any bank transfer fees.

LIABILITY

MyLuxuryChauffeur.com is only liable for damages caused by its own gross negligence or intent. The TSP is responsible for the transportation service, and MyLuxuryChauffeur.com assumes no liability for the actions of the TSP. Limitations of liability do not apply in cases of injury, death, or product liability claims.

CHANGES TO THE PLATFORM

MyLuxuryChauffeur.com reserves the right to modify or discontinue its services at any time. Any significant changes will be communicated to the user when reasonable.

COPYRIGHT AND USAGE RIGHTS

All content on MyLuxuryChauffeur.com is protected by copyright. The user is granted a limited, revocable right to use the platform for its intended purpose and in accordance with these T&Cs.

FINAL PROVISIONS

Entire Agreement: These T&Cs represent the entire agreement between MyLuxuryChauffeur.com and the user. Any amendments must be in writing to be valid.

Applicable Law: The laws of [Your Jurisdiction] shall govern these T&Cs. Any disputes will be resolved in the courts of London.
